Terms of Service.

1. Agreement to these Terms

These Terms of Service, the "Terms," are a binding agreement between you and Tek, referred to as "Tek," "we," "us," or "our." They govern your access to and use of gettek.app, the Tek mobile application, beta programs, and related products and services that link to these Terms, collectively, the "Service."

By accessing or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service. If you use the Service for an organization, you represent that you have authority to bind it, and "you" includes that organization.

2. Eligibility and accounts

You must be at least 18 years old and legally capable of entering a contract to use the Service. The Service is not designed for children. You must provide accurate information, keep account access secure, and promptly notify us of suspected unauthorized activity. You are responsible for activity under your account to the extent permitted by law.

You may sign in through a third-party provider such as Apple or Google. Your relationship with that provider is governed by its terms. We may refuse registration, require verification, reclaim usernames, or limit accounts where reasonably necessary to protect the Service or comply with law.

3. The Service and your license

Subject to these Terms, Tek grants you a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable license to access and use the Service for lawful, noncommercial purposes. Any app-store license terms also apply. Tek may add, change, suspend, or discontinue features, including beta and free features, at any time. We will provide notice where required by law.

The Service may allow you to photograph, describe, scan, estimate, edit, and track meals, nutrition, body measurements, water, weight trends, and goals. Features, supported devices, and availability may vary by location and version. You are responsible for your device, internet access, carrier charges, backups, and any data you choose to export.

4. Wellness, nutrition, and AI disclaimer

Tek is a general wellness and informational tool. It is not a medical device, health care provider, dietitian, emergency service, or substitute for professional judgment.Nothing in the Service is medical advice, diagnosis, treatment, a prescription, or a guarantee of any health, weight, or nutrition outcome.

• Meal recognition, portions, calories, macronutrients, ingredient identification, health scores, targets, and trends are estimates and may be incomplete, inaccurate, or unsuitable for you.
• AI can misidentify foods and cannot reliably detect hidden ingredients, allergens, contamination, preparation methods, alcohol, medication interactions, or food safety.
• Database information may be submitted by third parties, outdated, incomplete, or inconsistent with the product you consumed. Product labels and qualified professional advice control.
• Calorie needs and body responses vary. Review all results and use your own judgment before relying on them.

Consult a qualified physician or registered dietitian before making material dietary or health changes, especially if you are pregnant, under medical care, taking medication, have allergies, have diabetes or another health condition, or have a history of disordered eating. Stop using the Service and seek professional support if tracking causes distress or unsafe behavior. In an emergency, contact local emergency services. Never delay or disregard professional advice because of information from Tek.

5. Your content

"Your Content" means photos, descriptions, corrections, profile information, diary entries, feedback, and other material you submit through the Service. You retain ownership of Your Content. You grant Tek a worldwide, nonexclusive, royalty-free license to host, copy, transmit, process, format, and display Your Content only as reasonably necessary to operate, secure, support, and improve the Service, comply with law, and fulfill your instructions. This license ends when the content is deleted from our active systems, except as needed for legal compliance, security, dispute resolution, or limited backup retention.

You represent that you have the rights and permissions needed to submit Your Content and that its submission and our permitted use will not violate law or another person's rights. Do not upload another person's image, health information, or private information without valid permission. You are responsible for reviewing, correcting, exporting, and backing up Your Content. Our handling of personal information is described in the Privacy Policy.

6. Acceptable use

You must not, and must not help anyone else to:

• use the Service unlawfully, deceptively, fraudulently, or to harm any person;
• upload unlawful, infringing, malicious, or privacy-invasive content;
• access another person's account or collect information about others without authorization;
• bypass access, rate, security, or technical restrictions;
• interfere with the Service, introduce malware, overload systems, or probe vulnerabilities;
• copy, sell, rent, sublicense, distribute, or commercially exploit the Service except as we expressly allow;
• reverse engineer, decompile, or attempt to extract source code, models, prompts, or nonpublic data, except to the limited extent a restriction is prohibited by law;
• use automated means to scrape or access the Service without our written permission;
• use outputs to develop or train a competing model or service, or misrepresent AI-generated output as professionally verified; or
• use the Service for clinical diagnosis, emergency response, or another high-risk purpose.

We may investigate suspected violations and remove content or restrict access where reasonably necessary. We may cooperate with lawful authorities and preserve information as required by law.

7. Tek ownership and feedback

The Service, including its software, design, branding, interfaces, text, graphics, and other content supplied by Tek, is owned by Tek or its licensors and protected by intellectual property laws. Except for the limited license in Section 3, no rights are granted to you. Tek names, logos, and marks may not be used without written permission.

If you send ideas, suggestions, or other feedback, you grant Tek a perpetual, irrevocable, worldwide, royalty-free right to use it without restriction or compensation, provided we do not publicly identify you as its source without permission.

8. Third-party services and content

The Service may interoperate with or link to third-party services, data, and content, including Apple, Google, OpenAI, Cloudflare, USDA FoodData Central, and Open Food Facts. Tek does not control and is not responsible for third-party services, their availability, accuracy, security, or practices. Third-party terms may apply. References to a third party do not imply endorsement.

Apple App Store terms

If you obtain the app from Apple's App Store, these Terms are between you and Tek, not Apple. Apple has no obligation to furnish maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, to the extent required by its terms. Apple is not responsible for claims relating to the app, including product-liability, legal-compliance, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also comply with the App Store terms and applicable usage rules.

9. Beta, preview, and free features

Beta, preview, experimental, and early-access features may be incomplete, inaccurate, unstable, or changed or withdrawn without notice. Data may be reset or lost. Use them at your own risk and do not rely on them for time-sensitive, medical, safety-critical, or production purposes. Any feedback or nonpublic information about a closed beta may be treated as confidential if we tell you it is confidential.

10. Fees and purchases

Some features may later require payment. Before charging you, we will disclose the price, billing period, renewal terms, and cancellation method. Taxes may apply. App-store purchases, refunds, subscriptions, and cancellations are processed under the store's rules. Except where law or the applicable store requires otherwise, fees are nonrefundable once the paid period or service begins.

11. Suspension and termination

You may stop using the Service at any time. You may delete on-device data through the app and may request deletion of Tek-held account data as described in the Privacy Policy. Uninstalling the app or deleting local data does not necessarily cancel a subscription or delete synced account data.

We may suspend or terminate access if you materially or repeatedly violate these Terms, create legal or security risk, fail to pay applicable fees, or if continued operation is no longer commercially reasonable. Where appropriate and legally required, we will provide notice and a reasonable opportunity to cure. Sections that by nature should survive termination do survive, including ownership, disclaimers, liability limits, indemnity, disputes, and general terms.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TEK AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, ACCURATE, COMPLETE, OR COMPATIBLE WITH EVERY DEVICE, OR THAT DATA WILL NOT BE LOST.

Some jurisdictions do not allow certain warranty exclusions. In that case, the exclusions apply only to the fullest extent permitted, and your nonwaivable consumer rights remain unaffected.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, DATA, BUSINESS, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TEK FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR (B) US $100.

These limits apply regardless of legal theory and even if a remedy fails its essential purpose. They do not limit liability that cannot lawfully be limited, which may include liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or violation of nonwaivable consumer rights. The limitations reflect the allocation of risk and are an essential basis of the agreement.

14. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Tek and its affiliates, officers, employees, agents, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from Your Content, your misuse of the Service, or your material violation of these Terms or another person's rights. This obligation does not apply to the extent a claim results from Tek's own unlawful conduct or where indemnification is prohibited by law. Tek may control the defense of a covered claim, and you agree to reasonably cooperate. You may not settle a claim that admits fault by or imposes obligations on Tek without our written consent.

15. Governing law and disputes

Before filing a formal claim, you and Tek agree to try in good faith to resolve the dispute by emailing a written description and requested resolution to hello@gettek.app. Either party may proceed after 30 days if the dispute is not resolved. This informal process does not prevent either party from seeking urgent injunctive relief or using a small-claims process where eligible, and any limitation period is paused during the 30-day period where law permits.

These Terms are governed by the laws applicable where Tek is established, without regard to conflict-of-law rules. Courts located there have nonexclusive jurisdiction, unless applicable consumer law gives you the right to use the law or courts of your home jurisdiction. Nothing in these Terms deprives you of mandatory rights or remedies available under applicable law.

16. General terms

• Changes: We may update these Terms. We will post the revised Terms and update the date above. We will provide additional notice of material changes where required. Changes apply prospectively. If you do not agree, stop using the Service.
• Assignment: You may not assign these Terms without our written consent. Tek may assign them in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law, subject to applicable consumer rights.
• Severability: If a provision is unenforceable, it will be enforced to the maximum permissible extent and the remaining provisions remain effective.
• No waiver: A failure to enforce a provision is not a waiver. Waivers must be in writing and apply only to the specific instance.
• Force majeure: Tek is not responsible for delay or failure caused by events beyond its reasonable control.
• Export and sanctions: You must comply with applicable trade-control and sanctions laws and may not use the Service where prohibited.
• Entire agreement: These Terms, the Privacy Policy, and any additional terms presented for a feature are the entire agreement about the Service and supersede prior or contemporaneous agreements on that subject.
